Do I Have a Lawyer?


This question comes up all the time. The most common time I hear this question is when someone hires a lawyer and then has several charges or cases. Sometimes I hear this question when someone has a lawyer but then has another legal problem. Do you have a lawyer is the question asked by the judge. Do you have a lawyer is a question asked by the prosecutor. Do you have a lawyer is the question asked by the attorney on the other side of your case. The question has several answers and depends on several circumstances. Lets try to answer the question – Do I have a lawyer.

Do I have a lawyer? The question is sometimes asked by a judge. The first question is have you paid a lawyer? Some folks call a lawyer on the phone. The lawyer says “I sure would be happy to represent you.” Of course he would but is he hired or “retained” to represent you? If there is no money involved then you don’t have a lawyer. As I mentioned you have the right to be represented by an attorney and you have the right to represent yourself. If you are represented another lawyer, like the DA, should not talk to you without your lawyer. The DA can get in big trouble for talking about your case without your lawyer being there at the same time.

One of the rules of legal ethics is that if I represent a person I cannot talk to the other side when they are represented. It may seem a lawyer is being picky by not talking to you if your lawyer is late or out of town. The lawyer is not being picky he or she is being very careful.

Do I have a lawyer? Have you gotten into other legal problems? Maybe you hired a lawyer for a drug case. It went to court and was bound over to the grand jury. Now the case is in Criminal or Circuit Court. It is now a new case. You need a lawyer again. New fee. Maybe you hired a lawyer for your marijuana case then decide you need a divorce.
