IS DUI A FELONY?

Driving Under the Influence (DUI) and Driving While Impaired (DWI) essentially stand for the same thing and are used interchangeably. The most common reason a person is charged with DUI is that the person is believed to be under the influence of alcohol or controlled by a substance in his/her nervous system. However, there are many other reasons a person can be charged with DUI including having an alcohol concentration of 0.08 or more and being under the influence of a hazardous substance that affects the nervous system or brain.

DUIs range from misdemeanors to felonies. DUIs are enhanceable offenses, which means a conviction for a DUI can lead to more serious penalties if charged with another DUI in the future.


THERE ARE FOUR DEGREES OF DUIs. THE DEGREE DEPENDS ON A NUMBER OF FACTORS. SOME OF THEM INCLUDE:


* Refusal to take a blood, urine or breath test


* An alcohol reading of 0.16 and above


* Having a child under the age of 16 in the vehicle (if the child is 36 months and above younger than the offender)


* Prior DUIs or loss of driver’s license that was related to a DWI
